RIVERS COURT RESTRAINS POLICE FROM TRANSFERRING DEFENDANTS IN SLAIN DPO TO ABUJA


The Nigerian police is now restrained from re-arresting any defendant already standing trial in the murder charge over the killing of late Bako Angbashim, former DPO of Ahoada Divisional Police.


A Rivers State High Court sitting in Port Harcourt, presided over by Justice Sika Aprioku, issued the restraining order.


The order of court also restrained the Nigerian Police from taking any of the defendants already on trial, move or plan to move the case file of the murder case from Port Harcourt to the Abuja High Court.


Justice Aprioku applauded the conduct of the prosecution team of Nigeria Police and Rivers State Department of Public Prosecution led by C.F Amadi.


They had both insisted, justice Aprioku noted, that only those whose cases have been established in the case file can be tried after amending the charges.


The trial judge also said it was wrong that some defendants in the murder case are already being prosecuted in Abuja for the murder when the main case file is already in Rivers State High Court.


Justice Aprioku described such practice as illegal and a breach of court processes, citing Section 67 of the Administration of Criminal Justice.


Justice Aprioku adjourned further hearing on the matter to March 15, 2024.
